When someone violates Probation or Parole, they no longer have the right to a Jury Trial and a Judge, solely will determine whether to revoke or reinstate the Probation or Parole.
He/she will review the case under a “Preponderence of the Evidence” standard as opposed to the much harder to reach “Beyond All Reasonable Doubts” standard available in jury trials.
